PRIVSPOT — TERMS OF USE

I. About PrivSpot
PrivSpot ("PrivSpot", "we", "us" or "our") is an AI-powered Privacy Notice health-check and assessment service available through https://www.privspot.com/.
PrivSpot allows users to submit a Privacy Policy or Privacy Notice URL or Website URL for an automated assessment against the requirements and criteria used by the PrivSpot service and receive a detailed assessment report.
By accessing or using PrivSpot, you agree to these Terms of Use ("Terms"). If you do not agree with these Terms, you should not use the service.
II. Eligibility and Authority
You may use PrivSpot only if you are legally capable of entering into a binding agreement under applicable law.
If you submit a Privacy Policy, Privacy Notice, company information or other information on behalf of a company, organisation or another person, you represent that you are authorised to do so. You are responsible for ensuring that your use of PrivSpot complies with all laws and regulations applicable to you.
III. The PrivSpot Service
PrivSpot provides an automated privacy-document assessment service.
The service may include:
- accepting information submitted by you;
- receiving and processing the Privacy Policy or Privacy Notice URL or Website URL submitted by you;
- retrieving publicly accessible webpage content associated with that URL;
- analysing the submitted content using automated and AI-assisted processes;
- assessing the content against the criteria used by PrivSpot;
- generating a score, findings, identified gaps and recommendations; and
- providing the resulting report for download.
The precise features, assessment criteria and format of the report may change from time to time.
IV. Nature of the Assessment
PrivSpot provides an automated compliance assessment and informational analysis.
The PrivSpot report is intended to help identify potential gaps, omissions or areas requiring attention in a Privacy Policy or Privacy Notice. The assessment is not a certification, approval, legal opinion, legal audit, regulatory determination, or guarantee of compliance with any law.
A report generated by PrivSpot does not establish that a Privacy Policy is legally compliant merely because a particular requirement receives a positive assessment. Similarly, an identified gap does not necessarily mean that a legal violation has occurred.
You remain responsible for reviewing the report and determining what action, if any, should be taken.
V. No Legal Advice
PrivSpot is a technology-based assessment service and does not, by itself, constitute legal advice, legal representation, an advocate-client relationship or a substitute for advice from a qualified legal professional.
The assessment may not consider all facts, circumstances, contractual arrangements, technical configurations, organisational practices or legal requirements applicable to your business. Where a legal interpretation, implementation decision or regulatory response is required, you should obtain appropriate professional advice.
VI. Accuracy and Limitations of AI-Assisted Analysis
PrivSpot uses automated and AI-assisted processing, including Google Gemini/Gemini API services, as part of its assessment workflow.
AI-assisted systems may produce incomplete, inaccurate, outdated, or contextually inappropriate results. Accordingly:
- you should independently review the assessment and recommendations;
- PrivSpot does not guarantee that every legal requirement, issue or drafting deficiency will be identified;
- PrivSpot does not guarantee that every identified issue is legally applicable to your circumstances; and
- you should not rely solely on an automated assessment when making material legal, regulatory or business decisions.
The assessment criteria and AI-generated analysis may be updated as the PrivSpot service evolves.
VII. Information You Submit
To use the Privacy Notice Health Check, you may be required to provide information such as:
- your name;
- company or application name;
- contact email; and
- the Privacy Policy or Privacy Notice URL/Website URL to be assessed.
The Privacy Notice explains how personal data submitted to PrivSpot is processed. You are responsible for ensuring that the information you submit is accurate and that you have the necessary authority and rights to submit it.
VIII. Submitted Privacy Policy or Privacy Notice
When you submit a URL, PrivSpot may retrieve and process the publicly accessible content associated with that URL for the purpose of conducting the requested assessment and generating the report.
You must not knowingly submit:
- a URL that you do not have the right or authority to submit for assessment;
- content that you are prohibited from sharing or processing;
- confidential information that you do not wish to have processed through the PrivSpot assessment workflow; or
- information for which processing by PrivSpot or its service providers would be unlawful.
You acknowledge that a Privacy Policy or Privacy Notice may itself contain personal information belonging to third parties. Such information may be processed as part of the assessment workflow where technically necessary to provide the service.
XI. Third-Party Services
PrivSpot may rely on third-party service providers for hosting, infrastructure, AI processing, payment processing, email, security and other technical functions necessary to operate the service.
The Privacy Notice explains the categories of third-party processing that may occur.
Third-party services are subject to their own terms and policies. You are responsible for reviewing the applicable terms of third-party services where relevant.
X. Payment
Certain PrivSpot services may require payment. Payments may be processed through Razorpay. PrivSpot does not intend to receive or store complete payment card or banking credentials and may receive limited transaction-related information necessary to confirm payment and provide the requested service.
The applicable price will be displayed to you before payment is completed. A payment is treated as completed only after confirmation through the applicable payment system.
Unless expressly stated otherwise at the time of purchase, payment is for the PrivSpot assessment service and report requested by you.
XI. Report Generation and Delivery
Following completion of the assessment, PrivSpot generates the requested report and makes it available for download.
The service is designed around delivery of the generated report rather than maintaining a permanent report library for users. Temporary processing or storage may nevertheless occur where technically necessary.
You are responsible for downloading and securely retaining your report if you require it for future reference.
PrivSpot does not guarantee that a previously generated report will remain available indefinitely.
XII. Intellectual Property
All rights in and to the PrivSpot website, service, software, design, branding, trademarks, logos, assessment methodology, scoring framework, report format, text, graphics and other materials provided by PrivSpot, excluding user-submitted content, are owned by or licensed to PrivSpot.
You may use the report generated for you for your own internal business, compliance and legal purposes.
You must not, without prior written permission:
- reproduce or commercially resell the PrivSpot service;
- copy or reproduce the PrivSpot assessment methodology or scoring framework for use in a competing service;
- reverse engineer or attempt to extract the underlying software or systems;
- systematically scrape or reproduce PrivSpot content; or
- represent PrivSpot's assessment methodology or report as your own proprietary assessment service.
XIII. Your Content
You retain your rights in content that you submit to PrivSpot. By submitting content to PrivSpot, you provide PrivSpot and its relevant service providers with the limited permission necessary to access, process, analyse and use that content for the purpose of providing the requested service and operating the PrivSpot platform. This permission does not give PrivSpot ownership of your underlying Privacy Policy or other content you submit.
XIV. Acceptable Use
You must use PrivSpot only for lawful purposes. You must not:
- use PrivSpot in violation of applicable law;
- interfere with or attempt to disrupt the operation or security of PrivSpot;
- attempt to gain unauthorised access to PrivSpot systems or another user's information;
- introduce malicious code, malware or harmful material;
- use automated means to abuse or overload the service;
- attempt to circumvent security, authentication or access controls;
- use PrivSpot to process information that you are not authorised to submit; or
- use the PrivSpot service to develop, train or operate a competing service through systematic extraction of PrivSpot's proprietary assessment methodology or content.
XV. Security and Service Availability
PrivSpot takes reasonable technical and organisational measures appropriate to the service to protect information against unauthorised access, disclosure, alteration, loss, misuse or destruction. However, no internet-based service can be guaranteed to be completely secure or continuously available.
PrivSpot does not guarantee that:
- the website will always be available;
- the service will operate without interruption or error;
- the assessment will always be completed successfully;
- every submitted URL will be accessible or retrievable; or
- every report will be generated without technical failure.
PrivSpot may temporarily suspend or restrict access where reasonably necessary for maintenance, security, technical issues, or other operational reasons.
XVI. Third-Party Websites and Links
PrivSpot may contain links to third-party websites or rely on third-party services. PrivSpot does not control independent third-party websites or their privacy, security, availability, or content. Your use of third-party services is subject to the terms and policies applicable to those services.
XVII. Disclaimer of Warranties
To the maximum extent permitted by applicable law, PrivSpot is provided on an "as available" basis. PrivSpot does not warrant that the service, assessment, report or information provided through the service will be:
- Complete;
- Error-free;
- Uninterrupted;
- suitable for every legal or business situation;
- current with every applicable legal development; or
- sufficient by itself to establish legal or regulatory compliance.
The assessment is a decision-support and gap-identification tool and should be evaluated in the context of the user's actual legal, technical and operational circumstances, and we will not be liable for any loss or damage of any nature.
XVIII. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRIVSPOT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE LOSSES ARISING FROM OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
THIS INCLUDES, TO THE EXTENT LEGALLY PERMITTED, LOSSES ARISING FROM RELIANCE ON AN AUTOMATED ASSESSMENT, FAILURE TO IDENTIFY A LEGAL OR COMPLIANCE ISSUE, INTERRUPTION OF THE SERVICE, LOSS OF DATA, OR DECISIONS MADE ON THE BASIS OF A PRIVSPOT REPORT.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
XIX. User Responsibility
You are responsible for:
- the information and URLs you submit;
- ensuring that you have the necessary rights and authority to submit such information;
- reviewing the generated assessment before relying on it;
- obtaining professional legal advice where appropriate;
- maintaining copies of reports that you need for your records; and
- determining whether and how to implement any recommendation contained in a PrivSpot report.
XX. Suspension or Termination
PrivSpot may suspend or restrict access to the service where reasonably necessary, including where:
- these Terms are violated;
- the service is being used unlawfully;
- misuse or abuse of the service is detected;
- security or operational risks arise; or
- suspension is necessary for maintenance or protection of the service.
Where reasonably practicable, PrivSpot may provide notice before a non-urgent suspension.
Termination or suspension of access does not affect provisions that by their nature are intended to continue, including provisions concerning intellectual property, disclaimers, limitation of liability and governing law.
XXI. Privacy and Cookies
Your use of PrivSpot is also governed by the PrivSpot Privacy Notice and Cookie Policy. The Privacy Notice explains how personal data is collected, processed, retained, deleted and protected.
The Cookie Policy explains the use of cookies and similar technologies. These documents form part of the information governing your use of the service and should be read together with these Terms.
XXII. Changes to the Service or Terms
PrivSpot may modify, suspend, discontinue or introduce features to the service from time to time. PrivSpot may also update these Terms to reflect changes in the service, technology, legal requirements or business practices. The updated Terms will be published on the PrivSpot website with an updated "Last Updated" date. Where applicable law requires additional notice or consent, PrivSpot will take the steps required by law.
XXIII. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India.
Any dispute arising out of or relating to these Terms or the use of PrivSpot shall be subject to the jurisdiction of the State of Delhi.
XXIV. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable, where legally permissible. The remaining provisions shall continue in full force and effect.
XXV. Entire Agreement
These Terms, together with the PrivSpot Privacy Notice, Cookie Policy and any other terms expressly incorporated into the service, constitute the agreement governing your use of PrivSpot, to the extent applicable.

Users should exercise independent judgment and obtain professional advice where appropriate before relying on the assessment for material legal, regulatory or business decisions.
